By accessing or using the Atlantic Source website at atlanticsource.net, scheduling a consultation, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.
These terms constitute a legally binding agreement between you and Atlantic Source, a home organization and design company based in Sussex County, Delaware.
Atlantic Source provides custom home organization, design, and installation services, including but not limited to:
All services are subject to availability and may vary based on your location within our service area, which primarily covers Sussex County and Kent County, Delaware.
We offer free in-home design consultations at no cost or obligation. During a consultation, our team will:
Estimates provided during consultations are based on the information available at the time and are subject to change if project specifications change or unforeseen conditions are discovered during installation. A formal written proposal must be signed before any work begins.
All projects require a signed agreement before work commences. This agreement will outline:
Changes to the agreed scope of work after signing may result in additional charges and adjusted timelines. Any modifications must be agreed upon in writing by both parties.
Electronic signatures & records. Proposals and contracts may be reviewed and signed electronically through our secure client portal. By signing electronically, you agree that your electronic signature is legally binding and has the same force and effect as a handwritten signature under the federal ESIGN Act and Delaware's Uniform Electronic Transactions Act, and that we may deliver contracts, notices, receipts, and related records to you electronically. You may request a free paper copy of any signed contract at any time by contacting us. To view electronic records you need a device with internet access, a current web browser, and a valid email address.
Email communications. By entering into a project agreement with Atlantic Source — including signing a contract or estimate through our customer portal — you agree that, as part of our ongoing customer relationship, we may contact you by email with promotional materials, announcements of new products and services, special offers, and newsletters at the email address associated with your account. You may opt out of these promotional emails at any time using the unsubscribe link included in every such message, or by contacting us at info@atlanticsource.net. Opting out will not affect transactional or service-related messages about your own projects, such as contracts, invoices, payment receipts, and project updates, which you will continue to receive.
Calls & text messages (SMS). When you provide your phone number — on our consultation form or as part of a project agreement — you agree that Atlantic Source may contact you by phone call and text message about your inquiry, consultation, and project, including appointment confirmations, status and payment updates, and occasional requests for feedback. These messages come from our staffed business line, not an automated system. Message frequency varies and message and data rates may apply. You can opt out at any time by replying to a message asking us to stop, or by calling or emailing us; opting out will not affect the services you have requested. Consent to receive texts is not a condition of purchasing any goods or services. See our Privacy Policy for how we handle this information.
Payment terms are outlined in each individual project agreement. General payment policies include:
Late payments may be subject to additional fees as specified in your project agreement. If you have questions about billing, please contact us at info@atlanticsource.net.
Deposits and payments are non-refundable. Because our work is custom-designed and built or ordered specifically for your project, all deposits and payments are non-refundable. This includes deposits, progress payments, and final payments. If you cancel a project after signing your agreement, you remain responsible for the full contract amount, and amounts already paid will not be refunded. Nothing in this section limits any right you may have under applicable law.
Workmanship concerns. If you are not satisfied with our workmanship, contact us and we will work in good faith to correct the issue under the warranty described in Section 6.
Atlantic Source stands behind the quality of our work and materials. Our warranty coverage includes:
Warranty coverage does not extend to damage caused by misuse, unauthorized modifications, natural disasters, or normal wear and tear. Specific warranty terms are detailed in your project agreement. To make a warranty claim, contact us directly and we will work to resolve the issue promptly.
All content on the Atlantic Source website — including text, images, graphics, logos, 3D renderings, design concepts, and code — is the property of Atlantic Source or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on our website without prior written consent. Custom designs created for your project are provided for your personal use in connection with the agreed-upon installation only.
When using our website, you agree not to:
We reserve the right to restrict or terminate access to our website for any user who violates these terms.
To the fullest extent permitted by law, Atlantic Source shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
Our total liability for any claim related to our services shall not exceed the total amount you paid for the specific service giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless Atlantic Source, its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of our website, violation of these terms, or infringement of any third-party rights.
We reserve the right to update or modify these Terms of Service at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Your continued use of our website or services following any changes constitutes your acceptance of the revised terms.
We encourage you to review these terms periodically. For significant changes that may affect your rights, we will make reasonable efforts to provide notice.
